Este é um estudo sobre a mediação da cultura no processo de compreensão e interpretação das normas jurídicas na determinação de seu significado e alcance de sua aplicação concreta, com base no estudo da obra Verdade e Método, de Hans-Georg Gadamer, analisa-se o papel da cultura no procedimento hermenêutico jurídico, tanto do ponto de vista do intérprete, quanto do destinatário da norma jurídica, onde o jurista entra no jogo da interpretação da norma, com o conjunto de preconceitos proporcionado pela tradição, (...) tendo um horizonte que deve fundir-se com o horizonte do caso concreto, para produzir simultaneamente uma compreensão e interpretação da norma, que permita resolver o caso concreto, por uma solução interpretativa criativa que se manifesta através da linguagem, que no que lhe concerne é um produto cultural que permite a compreensão e expressão do pensamento humano em diálogo até com outras culturas, para que a cultura seja o palco, o horizonte onde se dá o processo histórico de formação e aplicação do ordenamento jurídico. Los y las estudiantes denominados migrantes internos o interregionales, así como los jóvenes migrantes retornados o pertenecientes a la generación 1.5 enfrentan un cúmulo de adversidades que deben sortear durante sus trayectorias escolares en la universidad pública y en muchos de los casos no son visibilizadas ni atendidas por las IES. En el presente ensayo se pretende proveer algunas estrategias que puedan servir de punto de partida para la atención y seguimiento a estos grupos de población estudiantil.

Esta introdução descreve os mais importantes dados biográficos da vida e da obra do físico teórico austríaco Ludwig Boltzmann (1844-1906). As principais contribuições científicas de Boltzmann situam-se nos domínios da teoria cinética dos gases e mecânica estatística, da qual ele foi um dos fundadores. A tese de que as teorias científicas são representações dos fenômenos naturais é encontrada em todos os artigos de Boltzmann. No verbete "modelo", ela é apresentada de modo mais organizado, o que o torna uma peça fundamental (...) para a compreensão do pensamento filosófico do físico austríaco. O verbete, publicado na famosa enciclopédia Britannica, foi escrito para o público em geral. Ainda assim, Boltzmann não se eximiu de tomar partido em favor do uso de modelos. Estes últimos não apenas seriam inevitáveis, mas necessários, uma vez que tornavam possível o aperfeiçoamento contínuo da ciência. This introduction describes the most important biographical details of the life and work of the Austrian theoretical physicist Ludwig Boltzmann (1844-1906). The main scientific contributions of Boltzmann can be found in areas such as the kinetic theory of gases and statistical mechanics, of which he was one of the co-founders. The thesis that scientific theories are representations of natural phenomena is found in all philosophical articles by Boltzmann. In the entry "model", published in the celebrated Encyclopedia Britannica, the thesis is presented in a more organized way, making it the keystone to understand the philosophical thought of the Austrian physicist. Although the entry was written for the general public, in it Boltzmann did not refrain from taking sides as far as the use of models is concerned. According to him, the latter would not only be inevitable, but in fact necessary, since they would made possible the continuous improvement of science. (shrink)

Este texto, aprovechando la reciente publicación del último Premio Espasa de Ensayo, Lenguas en guerra, de Irene Lozano, hace un recorrido por las ideas más destacables del libro, tanto sobre el origen filogenético del lenguaje como sobre la problemática relación que este origen supone, según la autora, para las justificaciones al uso sobre los nacionalismos fundamentados en la singularidad de la lengua propia, y sitúa estas ideas en el contexto de los conocimientos que se tienen hoy sobre evolución, genética e (...) historia del pensamiento. El texto también hace una crítica a algunos de los razonamientos de Lozano y presta atención al contraste entre su perspectiva idealista sobre la funcionalidad y el uso recto del lenguaje y su visión más pragmática y posibilista sobre el nacionalismo y el conservacionismo lingüístico. Como habitantes e investigadores de las luchas que emergen desde situaciones de contaminación en la zona sur de la ciudad de Córdoba, nuestro interés es analizar los modos de construcción de las identidades políticas en estos contextos discursivos situados. Metodológicamente, apelamos a los desarrollos de Laclau para el análisis de las prácticas articulatorias, tomando como herramientas para el análisis del discurso las figuras de la retórica clásica (sinécdoque, catacresis, metáfora y metonimia); como unidad de análisis, cuatro experiencias de luchas desde (...) situaciones de contaminación; y como corpus, el material recogido en entrevistas grupales en profundidad a fin de identificar los significantes privilegiados por los participantes para dar cuenta del interior/exterior del grupo y las operaciones de construcción de cadenas de equivalencias/diferencias, observando las dimensiones catacrésicas, sinecdóquicas, metafóricas y metonímicas en el uso de los significantes. Luego, nos centramos en el análisis de las distinciones vecinos/no vecinos, contaminación/ambiente, barrio/sector sur, afectado/no afectado. Como resultados, señalamos dos modos de articulación diferentes en la construcción de identidades desde situaciones de injusticia ambiental: la de los afectados directos, basada en vínculos metonímicos, en contigüidades con la fuente de contaminación; y otra, la de quienes no se reconocen como afectados directos, basada en vínculos metafóricos. The concept of unconscious knowledge is fundamental for an understanding of human thought processes and mentation in general; however, the psychological community at large is not familiar with it. This paper offers a survey of the main psychological research currently being carried out into cognitive processes, and examines pathways that can be integrated into a discipline of unconscious knowledge. It shows that the field has already a defined history and discusses some of the features that all kinds of unconscious knowledge (...) seem to share at a deeper level. With the aim of promoting further research, we discuss the main challenges which the postulation of unconscious cognition faces within the psychological community. (shrink)

Not focusing on the history of classical logic, this book provides discussions and quotes central passages on its origins and development, namely from a philosophical perspective. Not being a book in mathematical logic, it takes formal logic from an essentially mathematical perspective. Biased towards a computational approach, with SAT and VAL as its backbone, this is an introduction to logic that covers essential aspects of the three branches of logic, to wit, philosophical, mathematical, and computational.

This paper explores the relationships between American phenomenology of music and conventional studies of musical analysis. The temporality of experience is a central topic in the phenomenology of music: recent research in USA has focused on musical time-consciousness (Schutz and Smith) or on analytical applications (Clifton, Lochhead, Ferrara). Many methods of musical analysis, like phenomenological methods, are concerned to study subjective temporal structures: Schenkerian and post-Schenkerian scholars (Salzer, Meyer, Narmour, Lewin) have elaborated specific systems for the explanation of musical form (...) on a experiential basis. Apart from any comparison with the different approaches, phenomenological analysis appears to be fundamental for the analytical interpretation of music. (shrink)

In mainstream economic theory money functions as an instrument for the circulation of commodities or for keeping a stock of liquid wealth. In neither case is it considered fundamental to the production of goods or the distribution of income. Augusto Graziani challenges traditional theories of monetary production, arguing that a modern economy based on credit cannot be understood without a focus on the administration of credit flows. He argues that market asset configuration depends not upon consumer preferences and available (...) technologies but on how money and credit are managed. This article deals with a modern disease of academic science that consists of an enormous increase in the number of scientific publications without a corresponding advance of knowledge. Findings are sliced as thin as salami and submitted to different journals to produce more papers. If we consider academic papers as a kind of scientific ‘currency’ that is backed by gold bullion in the central bank of ‘true’ science, then we are witnessing an article-inflation phenomenon, a scientometric bubble that is most (...) harmful for science and promotes an unethical and antiscientific culture among researchers. The main problem behind the scenes is that the impact factor is used as a proxy for quality. Therefore, not only for convenience, but also based on ethical principles of scientific research, we adhere to the San Francisco Declaration on Research Assessment when it emphasizes “the need to eliminate the use of journal-based metrics in funding, appointment and promotion considerations; and the need to assess research on its own merits rather on the journal in which the research is published”. Our message is mainly addressed to the funding agencies and universities that award tenures or grants and manage research programmes, especially in developing countries. The message is also addressed to well-established scientists who have the power to change things when they participate in committees for grants and jobs. (shrink)

The van Wijngaarden grammars are two-level grammars that present many interesting properties. In the present article I elaborate on six of these properties, to wit, (i) their being constituted by two grammars, (ii) their ability to generate (possibly infinitely many) strict languages and their own metalanguage, (iii) their context-sensitivity, (iv) their high descriptive power, (v) their productivity, or the ability to generate an infinite number of production rules, and (vi) their equivalence with the unrestricted, or Type-0, Chomsky grammars.

Ontologies are some of the most central constructs in today's large plethora of knowledge technologies, namely in the context of the semantic web. As their coinage indicates, they are direct heirs to the ontological investigations in the long Western philosophical tradition, but it is not easy to make bridges between them. Contemporary ontological commitments often take causality as a central aspect for the ur-segregation of entities, especially in scientific upper ontologies; theories of causality and philosophical ontological investigations often go hand-in-hand, (...) and were essentially inseparable in medieval thought. This constitutes the foundation for a bridge, and this article analyzes the causality-based ontology of the late medieval philosopher Dietrich of Freiberg from the viewpoint of today's upper-ontology engineering. In this bridging attempt, it offers a translation into English of the first part of Dietrich's De origine (abbreviated title) that is a compromise between traditional scholarly translations of medieval Latin philosophical texts and contemporary ontology. Foundational ontologies, central constructs in ontological investigations and engineering alike, are based on ontological categories. Firstly proposed by Aristotle as the very ur- elements from which the whole of reality can be derived, they are not easy to identify, let alone partition and/or hierarchize; in particular, the question of their number poses serious challenges. The late medieval philosopher Dietrich of Freiberg wrote around 1286 a tutorial that can help us today with this exceedingly difficult task. In this paper, I discuss (...) ontological categories and their importance for foundational ontologies from both the contemporary perspective and the original Aristotelian viewpoint, I provide the translation from the Latin into English of Dietrich's De origine II with an introductory elaboration, and I extract a foundational ontology–that is in fact a single-category one–from this text rooted in Dietrich's specification of types of subjecthood and his conception of intentionality as causal operation. This article concerns Aquinas’s practical doctrine on two philosophical difficulties underlying much contemporary ethical debate. One is Hume’s Is-ought thesis and the other is its radical consequence, Moore’s Open-question argument. These ethical paradoxes appear to have their roots in epistemological scepticism and in a deficient anthropology. Possible response to them can be found in that Aquinas’s human intellect (essentially theoretical and practical at the same time) naturally performs three main operations: 1º) To apprehend the intellecta and universal notions ens, verum (...) and bonum. 2º) To formulate the first theoretical and practical principles. 3º) To order that the intellectum and universal good be done and the opposite avoided. Thomistic philosophical response to both predicaments will not be exclusively ethical, but will harmonically embrace ontology, anthropology and epistemology. (shrink)

Since Freud and his co-author Breuer spoke of dissociation in 1895, a scientific paradigm was painstakingly established in the field of unconscious cognition. This is the dissociation paradigm. However, recent critical analysis of the many and various reported dissociations reveals their blurred, or unveridical, character. Moreover, we remain ignorant with respect to the ways cognitive phenomena transition from consciousness to an unconscious mode. This hinders us from filling in the puzzle of the unified mind. We conclude that we have reached (...) a Kuhnian crisis in the field of unconscious cognition, and we predict that new models, incorporating partly the relevant findings of the dissociation paradigm—but also of dynamic psychology—, will soon be established. We further predict that some of these models will be largely based on the pairs representation–process and analog–digital. (shrink)

According to the mythical-religious literature time is determined by the eternal nature of divinity or origin of all things. From this adagio, theological literature is provoked and studies on the eternal nature of divinity suggest that if the universe was created the image of its creator the first must also be eternal. Therefore the question arises: how to shape that which by nature is formless, infinite, namely eternity? To answer this question the following paper develops a brief history about the (...) Judeo-Christian tradition on the problem of time and its relationship with eternity and also tries to prepare at the end one logical answer to the question about the form of eternity. (shrink)

In Color Harmonies, Augusto Garau systematically investigates the role of both color and form in visual perception and presents an original theory of the aesthetic relations among colors.

For millennia, knowledge has eluded a precise definition. The industrialization of knowledge (IoK) and the associated proliferation of the so-called knowledge communities in the last few decades caused this state of affairs to deteriorate, namely by creating a trio composed of data, knowledge, and information (DIK) that is not unlike the aporia of the trinity in philosophy. This calls for a general theory of knowledge (ToK) that can work as a foundation for a science of knowledge (SoK) and additionally distinguishes (...) knowledge from both data and information. In this paper, I attempt to sketch this generality via the establishing of both knowledge structures and knowledge systems that can then be adopted/adapted by the diverse communities for the respective knowledge technologies and practices. This is achieved by means of a formal–indeed, mathematical–approach to epistemological matters a.k.a. formal epistemology. The corresponding application focus is on knowledge systems implementable as computer programs. (shrink)

O presente estudo tem como tema o surveillance e a sociedade do controle biopolítico, sendo dada ênfase à conexão com o sistema penal e as tecnologias dispostas nas práticas de segurança. Tem-se como problema de pesquisa como e de que forma operam os “novos” mecanismos de surveillance em prol da segurança no modelo biopolítico do Estado penal? Conclui-se que o modelo de controle atual baseado em riscos e algoritmos emprega o surveillance em uma atuação securitária seletiva, adotando o discurso “científico/tecnológico” (...) como escusa para manutenção discriminatória de uma biopolítica da atuação penal voltada para morte de sujeitos e grupos sociais específicos. Por fim, a metodologia empregada compreende uma abordagem fenomenológico-hermenêutica, um método de procedimento monográfico e técnica de pesquisa por documentação indireta. (shrink)

Resumo: Com o fito de compreender as noções de história e juízo político, este artigo pretende mostrar a peculiar interpretação que Hannah Arendt faz da mais conhecida e discutida personalidade filosófica: Sócrates. Assim como outras ideias, tais como a de banalidade do mal, a natureza do terror totalitário e de espaço público, sua estrita pintura do filósofo grego nos demanda a tarefa de discriminar a diferença entre pensamento e ação. Seria acaso o juízo a ponte entre as atividades de pensamento (...) e da ação política? A preocupação, neste ensaio,é a de mostrar como Hannah Arendt estava procurando por um modo autêntico de filosofia política, cujo maior exemplo seria Sócrates. No mesmo sentido, também se debruça acerca do significado do juízo reflexionante, ideia bastante fecunda em sua obra que permanece ainda bastante alusiva.: In order to understand Arendt’s conceptions of history and political judgment, this article discusses her peculiar interpretation of Socrates. As with her other ideas, such as the banality of evil, the nature of totalitarian terror, and the public space, her portrayal of the Greek philosopher demands that we discriminate between thinking and acting. Would judgment by chance be the bridge between the activities of thought and political action? My aim in this essay is to show how Arendt, from beginning of her work, was looking for an authentic mode of political life, the major example of which is Socrates. I also address what Arendt meant by her idea of a reflexive judgment, an idea that has proved enormously suggestive yet which remains elusive. (shrink)
